5 of us in the department have the same job title, but 1 of those five is not held to the strict new attendance policy because she is "considered" to be management. The rest of us are penalized. I don't think this is legal.

All 5 employees are salaried and have the same title. I know a company can and will establish an attendance policy, but a very strict one for just 4 people when one of the other dept members has the same title and rights as the others??

If she is on salary, then she probably won't be held accountable. If she is hourly, she is probably screwing herself over on money. It has always been this way.

Companies are not democracies. The boss sets the policy. Unless you have a union to complain to you are out of luck. They can do whatever they want. What you should be concerned with is if someone other than the current occupant of the "management" position were in it would the policy be the same.

You always have 3 options at any company for whom you work. 1) You can stay and keep your mouth shut. 2) You can complain or protest and take your chances on getting fired. 30 You could go somewhere else.

If everything else is equal I would recommend number 1 but if it bugs you don't wait for 2 go directly to 3.

it depends on your policies. If she is management she may have a different set of rules from the rest of you because of her title now if you all carried the same title then it would be considered discrimination.

So you think it is illegal for a company to set an attendance policy for non-management employees....Well, you are wrong.

MOST companies have an attendance policy....
