Yes, if he refuses to pay and a reasonable amount of time has passed. Check with your state department of motor vehicles. There are rules you have to follow. I think that you would have hard time taking a car worth $40,000 for a $10 repair. See what I mean?

You can but it probably is not worth it. Unless there is a great deal of value involved I would just have it towed.
