The laws vary from state to state but what you have to do is establish residency. That is to prevent fraud. See a lawyer, you're going to need one anyway.

Okay, are you moving from one city in Texas to another city in Texas??
If so, you have to be a resident of the STATE for 90 days before filing.

Call the courts in Texas and the town you are in and see what the laws are there. It probably differs from state to state. Why did you have to move to a new city to divorce if i may ask?

In California you have to be a resident for 6 monhts before you can file in California. It varies from state to state
"My husband wants my son and I to move in with my parents awhile to save money, etc." So he is trying to move you OUT of the family home? He can't do that if you have a chld. I suggest you get yourself a lawyer NOW because he sounds as if he is planning something underhanded. WATCH YOUR BANK ACCOUNTS!!!

Seems to me you'd get a faster, straight, accurate answer by simply picking up the phone and calling a divorce attorney or paralegal in your local area.
I don't know much about Texas laws.
