Well your roomate has to leave anyway. If his name isn't on the lease he is known as an intruder. Your best bet would be to notify the landlord, if that doesn't work contact the police or try a restraining order, so it'd be impossible for him to live there in the first place.

if he refuses to leave u might want to call the police...u may get in trouble urself if u r the only one on the lease ,so get him out of there!if he gives u problems and keeps coming back u might want to get a restraining order on him! if he stays there,and u r the only one one the lease ..u r breaking the contract! its very legal to get someone out of ur house that u dont want in ur house! the police can explain all the legal stuff to uif he is a good friend he will understand ,but if he isn't u dont need him around anyways!

You'll have to check you local landlord tennant laws but here in Ontario your room mate is only considered a border not an actual tennant so you have no legal obligation to house him (so long as his name does not appear on the lease). But i highly recommend open communication, and also provide him some time to find another place to live cuz i dont know where you are but its freakin cold outside here ;).

I used to rent apartments and ran into this all the time. We would advise the person on the lease to give the roommate a eviction notice. Your landlord will supply one. Then after 30 days set their stuff out.
