Well, if there is no custody agreement, then
there is no "contract" in place - and sure, you can.
One might argue that it is unethical, but it will
certainly be legal.
Why not perform a "best effort" to get in touch with him
and if you fail, then be assured you did the best you could?

Yes you sure do...unless you want him coming out of the woodwork and charging you with kidnapping...So would it be worth tracking him down to avoid a prison sentence?
