about the trouble i have over the immigration system, not everyone knows or cares how really bad immigration is to people with familys, but i have a mexican wife traped in mexico and i'm american in the USA, i have a very nice marrage and a good wife for 6 years now, i can't move to mexico to live because we would have no money for anything and i could never afford to return to see my family here in the U.S, she can't come to live here because immigration is waiting us out, until our marrage is no longer practical for us and we end in divorce, so if i can't go their and she can't be here whats to be done about it, I have an approved (I-130) visa document INS now says is only paper, this is breaking us down slowly day by day, should we sue the fed government for pain and suffering, really whats more fair a husband and wife here, or a fuit picker looking for cash to take home, who has more rights to a visa,call a politition you get no return calls what will it take to have my life back.

If i call immigration about anything they say really you should visit your local INS office about that question, and when i visit them at the office, they say look on our web site for that answer, and when i look on the web site it says for more detailed info, make an appointment with your local INS office, i can see very clear its just a game to them nothing more, and they smile and say yes sir how may we help you,and then they don't, this problem should not be unwinnable for an american citizen, do i have any liberty or rights to a good life.

If you truly are an American citizen then I cant understand why this would happen,were you born in the US? if not did you take the exam and get sworn in or are you just here under legal immigrant status? Either way all you can do is petition,there are no guarantees so a law suit would not hold up.

I am sorry for you because your situation does sound legit to me. However, I think you need to direct your anger and frustration not at the US Government and INS, so much as at the illegal immigrants currently in the US at this time because they are what is causing the focus to be so much on immigration right now. Unfortunately, you should have tried to get her status correct before you married, but hindsight is always 20/20. Anyways, I see that a lot of people have given you some very good suggestions here, so I won't repeat what has already been said, other than I wish you luck to obtain your wife's legal status in the USA and I hope you will not resort to bringing her into the country illegally, because I believe you will only cause your pain to go on longer because then you will never know when she could be located and deported. Better to do it right and then be able to live securely thereafter. Good luck to you both!

I sympathize with your dilemma, it sounds as if you really love her and you want to try to make it work and you are trying to work LEGALLY with the system. IMO what I think I see happening is no one wants to do their job because they don't want added paperwork..or at least that is what it sounds like to me. Or your wife is being shoved to the back because there are so many illegal aliens here in the US right now.
Have you written letters about your dilemma? Phone calls can be ignored. Letters are harder to do so. If you have a visa (no, I don't know anything about the process of getting visas or anything about them) and it is approved...then how in the h*ll can it just be a piece of paper? I would start going up the chain and start talking with their bosses and get some answers.
If none of this helps then consider going to Mexico to be with her. Your marriage should come first. You can't sue the Government, because the Government is doing their job.

That is rough. I'm sorry to hear you are having such a difficult time. What you really need to do is contact an immigration attorney. Whatever state you are in, get online and look up their Bar Association and give them a call. They will help you find an attorney. If you two are already married and have been for six years, it should not be impossible to get her citizenship. It helps so much to fully understand the system, however, and that is why an attorney is so important. No one will understand the system better than a professional. It might cost some money, but it will be worth it.
That said, your situation is the perfect example of what is wrong with the immigration system. So many people hate illegal immigrants, not understanding how complex and nearly impossible it is for Mexicans to go through the "proper" channels. The way the system is now is like force feeding an obese man brownies and then criticizing him for having bad health. It is ridiculous.

You should find my blog and see Anna g on my friends page.Her husband was deported and her and her daughter was "deported also"or that's what I think because what choices did she have.Also I know you might be waiting through a waiting period But when you said your vows you said better or worse richer or poorer and this is worse and poor but if you love her you should really consider going to Mexico.I have another friend who is living in Mexico also with her husband but they are waiting to come back the Anna girl can never come back.But on with the you moving there.I say you should give up your family and move with your wife your wife SHOULD ALWAYS come first and when you married her you KNEW this could be something that could happen.Also my friend was REAL LT FREAKED OUT about moving but once she got there she realized it's not so bad.Her husband had a decent job because he speaks english and the other friend that moved there that gets to come back has less money than the other family but still said it was nothing like she thought it would be.I think the INS SUCKS I feel so sorry for the torn family's that they are doing this to .Good luck God Bless.

Yours is a valid, legal case! I am 100% pro-legal (equally anti-illegal) and I helped my wife immigrate from Asia. She had about a hundred college degrees, did most of the paperwork herself and got her PR (green card) in, I think, 2 or 3 months.
I can't figure out how this happened to you guys, honestly. Granted, my wife and I did the whole deal before 9/11 - she'd even gotten her full-fledged citizenship by then - but still, it shouldn't have come to this.
What I do know is that the INS today is a lot like the FAA's situation with the Air Traffic Controllers was in the late eighties - way under-tech'd and always making mistakes. They completely changed out their systems of automation - instead of upgrading stone-age equipment - and things cleared up really fast.
I'm not sure if it's tech-related, staffing shortages, archaic legislation or a combination of all 3 plus other things, but it sure needs fixing.
For all those who claim to be PRO-legal, heads up! This is a LEGAL and ABOVE BOARD case if I ever saw one. Cut the crap, okay?
If we really encourage legal immigration, there are no two ways about it: we have GOT to fix the immigration system. I think most of us have known for a while (DAR? Any comment here?) that this is one of the main areas to start (along with border security and sending back those who HAVE disregarded the law...that doesn't include you nor your wife).
Anyway, I feel for you. Let's continue to uphold the law as we repair the system.

You can't sue anybody. There's no right to immigrate.
I told you before. Get a job in San Diego and live with your family in Tijuana. Thousands of people do it. Walk over the border crossing each morning and catch the train right there at San Yisidro for the 20 minute ride into the city.
After the 10 year penalty is up your wife will be admissible.

Go right ahead an sue, i am an inmigrant myself and i'll been trapped in here for the past 13 years, thanks God, my son was born here 22 years ago, now he's going to apply for me, we couldn't do it before, cause money issues, and a lot of racist people that doesn't want to give you a job, but go right ahead and sue, cause you are suffering, you are loosing your wife little by little, and nobody cares but your own self, and I really hopes good things come your way, and your marriage can survive this chaotic situation regarding us in this country.

What kind of a case would you be suing the government about? There must be reasons for not granting permission. I think your mistake was made by not getting full information before marrying a foreigner in the first place.
