details, the person i hit left the scene of the crime. As he was probably drinking too. and secondly i have pictures proving his car is fine even though his insurance agency has called it totalled..........so basically am i screwed? or is it worth dishing out another 5k to fight. being that ive dished out about 5k so far for my d.w.i.

thanks in advance,

I take it law enforcement showed up at the scene? If so, how was the guy you hit able to put a claim on his insurance, if he left the scene? Did law enforcement arrest him for leaving the scene of an accident? If you have proof that his car is not damaged, I would fight the insurance company. There are lots of things going on here, and that other driver is holding some of the info. I don't understand how his insurance is going to file suit, or cover his damages if he left the scene, it doesn't make sense. A car can be considered "totalled" if it has incurred more damages then the car is worth, with unibody construction on newer cars, it doesn't take much of a hit to total them, as they are formed in one huge mold, instead of separate sections like older cars were made, and the separate sections could be removed and replaced. That attorney you have for the DWI, isn't he helping you on this case? It should be included, as it was the reason you got caught drinking, I would press him for some info. I don't think you are screwed, I think the guy you hit has something to hide, and you need to press forward to protect yourself. Get back with the attorney and work it out. By the way, I am hopeful that drunk driving is something in your past, it affects many people when an accident occurs, sometimes fatally, and it's usually the innocent victim that is injured. My ex had a problem with alcohol, we spent thousands on wrecks, DWI's, and a divorce. I hope this experience may have opened your eyes a bit on this subject, how would you have felt if you had killed someone in that wreck? I don't want to preach, just want to say that, you can make things change in your life, realizing that alcohol is causing you legal problems, and possibly relationships is the first step. I lost my best friend, the love of my life, my children lost their dad, all due to his alcoholism. He was two months past his 50th birthday when he passed away from cirrohis of the liver. I hope this wreck will be your turning point, good luck................

No insurance? Drinking? You rear-ended another car? The other guy left the scene? You have BOTH screwed yourselves, except you have done it twice as bad as him. He at least has insurance, and your details as well. And your pictures may show little damage from that angle, but an adjuster would look a lot closer than your cell-phone snap. Fighting it will only flush more money down the drain. I am a licenced insurance broker, and I am amazed at the people that drive without insurance. "Just expired" is the same as expired 6 months ago, it is no insurance, nada, zilch.

You are SOL! Insurance does not "expire" unless you stop paying it, or it gets cancelled by the ins. company. Going without insurance for even one day creates a "lapse", which means you rates will go up exponentially when you do renew for AT least a year, and on top of that, you will be charged fees that the DMV will assess for each day without insurance that you still had the registration for your car. Looks like you should have paid your insurance bill!

Dang, are you a couple a fries short of a happy meal or WHAT!?

You might be "basically screwed" depending on your state's laws!

Here are some questions to think about ...

1) Am I a driver licensed in the State of NY?

a) If so ... you in BIG TROUBLE man! DWI 1st offense is a misdemeanor, criminal charges to follow ... get a bus schedule!

2) Do I know that drinking and driving is stupid?

a) if so ... Here's your sign! [sign with words "I'm STUPID" delivered to DWI butthead]. As a former member of the Emergency Room staff at a busy [busy? try insane! Due to DWI related accidents] large city Hospital. I have lost all respect for you!

3) Do I think that drinking and driving is safe?

a) If so .... here's YOUR sign! [sign delivered with words "I'm EVEN STUPIDER" DELIVERED] Hot D*** don't you even know that the Emergency Room staff at EVERY Emergency Room in EVERY HOSPITAL in the USA is damn tired of cleaning up your messes!

CHRIST on a sidecar! I hope they throw the book at your sorry a**!

Not a good situation.

First off, when did the insurance expire exactly? You do know you get a 10 day grace period before they can even 'attempt' to cancel it, and then another ten days before they completely terminate the policy.

Ask them the exact dates and get it in writing or print-out. Get this without explaining the whole situation to them first. They'll be more apt to get you the info you need.

Hope this helped,
And NO MORE DRINKING AND DRIVING!

Don't waste your time or money. You can't win. You might as well just pay them. Meanwhile, get at least a liability only policy that will cover these types of things. You may want to try a website that compares multiple companies at once to get you the best price. I am paying less than ½ after I did.

It is my understanding that usually no one is 100% responsible for an accident, so even if it is 80% your fault and 20% his fault you could have a claim on his insurance, especially if you sustained some kind of personal injury as a result of the accident.

If you're positive there's no damage to his vehicle, then fight it.

Drinking and driving is so ridiculously idiotic, anyone who does and gets in an accident deserves whatever happens to them.
