I got a very sophisticated situation here. On 1/30/07, I got into a car accident and the other driver was at fault, but it took for the other driver's insurance company almost for a month to send me a check. Within a month, I got into another car accident, and this time I got struck from the behind again at the same spot. I already have received a check from the first insurance company, but I am still working on the issue with second insurance company. What should I do to resolve this doomed situation? The car is not yet fixed.

If the car had been fixed, this would be simple. Now you have to try and justify what is existing damage and what is new, because to accept payment for anything twice is fraud. Hopefully a really good body person can help you.

I take it you were rearended in the first accident as well as the second, correct? Do you have photos showing the damage from the first wreck, or a report from someone who looked it over for your insurance company? You are going to have to show that more damage occurred, from the second wreck. I also am wondering how old your car is, and if it was insurance destroyed/totalled by the first wreck, if it was and you haven't gotten the repairs made and an inspection done for the retitling of the car, legally you shouldn't have been driving the car, it should have been garaged and getting fixed. If that's what's going on, you will not receive reimbursement for the second wreck, and you could be ticketed for driving an unsafe vehicle.

haha.. how is that situation "sophisticated"- sophisticated means "fancy". I think the word your looking for is "complicated."

Well, if the first accident ONLY hit the bumper and they are paying to replace the bumper.. you are not owed another check to replace the bumper. You should probably show the second insurance company the first companies estimate- so they know which damage is new.

Of course.. you could not tell them about the first accident and get a second check for the damage. but you are facing a big risk here b/c if they find out its fraud and you can be charged.. and they have access to your accident records.

For starters .. stay the H*** away from that spot! Hot D*** that spot is unlucky for you!

Hit once there .. take a look at what you could have done to avoid further occurances! Hit twice at the SAME spot? Avoid a third trip there!

Is it a weird intersection (multiple roads converging at once ... roads meeting at weird angles etc ... )

As far as getting the car fixed ... what good is that if you still tempt fate by going to the same spot again?

Seriously ... hit once, bad luck ... hit TWICE at "the same spot" ... slow on the learning curve! Hit three times at the same spot? Here's your SIGN!!! (Sign with the words "I'm STUPID delivered to you)

I don't see fraud here...you were in two accidents. If you broke a leg and received payment for that and in the second accident the same leg was broken would you say no thanks it was already paid for? I'd take what you are offered from both companies. Then get rid of the car.....sounds like it might be jinxed.
