How could you not know the tin was empty before you opened it? An empty can weighs practically nothing and there is no movement inside it when you shake it. A full can weighs however much it says on the can and it sort of sloshes when you shake it.
As to your question you can probably call the manufacturer and ask for a refund. They may want you to send the empty can back however. The cost of the phone call and the cost of mailing the can back however would probably be more than the refund, but go for it if you think you need to prove a point.

If you bought a tin of evaporated milk (Always known at sea as Shaky Milk) and it turned out to be empty it could not be a tin of shaky milk - it could only be called a shaky milk tin...

Absolutely! Do you shop regularly at the store where you purchased it? Just speak (respectfully) to the store manager- explain that you're a regular customer and that you didn't notice that the can was too light (nor did the checkout person). Ask for a replacement or a refund, if you no longer need the evap. milk.

No way! In the first place when you picked it up you should have had enough sence to know it was empty. In the second place you can't prove to anyone you didn't use it and then wash the can out. Next time you buy some pick up 2 cans and see which one is heavier.

You would have to look for the expiration date on the can.More than likely you'd have to mail the can back to the factory,and by that time you could have bought out the whole store.

Write to the company who make/manufactures it. Similar thing happened to me with coke can and they send you tons of free coupons for that product.
Its well worth the complaint letter, you get free stuff!
