it is really important to not pick a name that is already in commercial use. First check out the on-line database for the US Trademark Office. Then run it through the database for Corporation names in New York, Secretary of State office. Most all states have on-line corporation database that can be searched for just this purpose. Also most states allow businesses that are not corporations to register and protect their business names, usually that can be searched at the same place as the corporation names. The reason for the research is once your school becomes successful, you don't want to be forced to change the name.

1- to my knowledge you don't need a "license" to open any business in new york that is not considered a "profession" by the education department (doctor, lawyer, cpa, accupuncture, etc.).

certain professions you DO need a license to operate- I'm not sure a martial arts school is one of them- I HIGHLY doubt that it is.

2- to protect your name a "copyright" or "trademark" are two different things.
You want to file your name as a certain business entity (corporation, limited liability company, etc.). It is by far cheaper to form a regular corporation up front -you don't have to publish in a paper that you formed it. forming your name preserves it so no one else can take it- they can take something similar, but to protect against that you need to file a federal trademark.

3- you need to find a space.

4- then look into insurance.

this is just the business info and has nothing to do with what you are teaching. make sure you outfit your school with the appropriate gear. I hope you are of the mindset to train properly and not run a mcdojo.
