Have you applied for a SSN for her? If you have you will need to wait. If not, you will need to fill out a W7 to apply7 for an Individual tax identification number (ITIN). You will then have to send in the application along with the tax return. The return will be processed in about 6-10 weeks.

You need to file a paper return along with an ITIN application for you wife and leave the space for her SS# blank on the return. IRS will issue an ITIN# and returns filed after that you will use the ITIN# for your wife. ITIN applications must be sent in with current years return and then when you get the ITIN# you can go back and amend previous years if needed. Please keep in mind that IRS is very picky about filling out the aplication correctly such as you can't leave any blank spots you must put n/a. errors on the ITIN application only slow down the process which is already a long one. If you yourself don't know how to do the work have someone certified or qualified to do the work and don't let someone rip you off I've heard many stories of people paying outrageous prices and never receiving ITIN#. I work for Liberty Tax in Ohio and we don't charge for ITIN work only the price of the return and we are certified. If you have any questions or concerns call your local Liberty Tax that is certified for ITIN work and they will be more than happy to help you or answer any question that you might have. You'll need to mail in your tax returns for this year. With the return you need to attach a form W-7 (application for a taxpayer identification number). The IRS will issue your wife a TIN for the time being. This number is just for tax purposes non other. Before next year, you need to get your wife a social security number. You can get the W-7 form on the IRS website at www.irs.gov.

Fill out a W7 for her.

There is a fillable pdf at IRS.gov

The W7, along with your return, needs to be mailed to a special ITIN unit of the IRS in Austin, TX. The return cannot be electronically filed. If you are expecting a refund, you should receive it in 6-8 weeks.

Everyone that said to file a w-7 is correct.
And if you are married, your best bet is to file jointly, whether your spouse works or not.

Go to your local Social Security office and apply for a social security card for her. It takes about 2 weeks. If she is legally in the country, there should be no problem getting a social security card for her. If social security office says you're missing something, then talk to the attorney who is helping you with her status. You do have an attorney, right?
Now, if you see that the process takes longer, just file an extension and file your tax return later when she gets her SS number. It really shouldn't take that long.

Go to the IRS and apply for a tax-ID number for her. She does not need a social security number to get one. The IRS is completely separate from the Social Security Administration.

Get her a social security card, it's very easy to do.

By filing jointly I assume your wife works. That's the only reason to file jointly. If she works I would assume she would get a W2. I don't know how she could without a Social Security Number.

You can always call the IRS.

you cannot file jointly yet. you have to wait until she gets her SSN before you can start filing jointly. Without an SSN, she is not considered as a citizen or resident.
