Recently, our local hospital has implemented a Dunkin Donuts within its main lobby... I have found that there is NO LINE there in the morning and have been going there to get my morning coffee (since the other Dunkin Donuts in town have a wait upwards of 20 minutes).

I normally park in the emergency parking area so I can run in and get my coffee, and up till this morning I have not had an issue. Today, my car was on the 'hooks' of a flat bed and they were moving it on when I came out. I tried to discuss this with the tow truck guy, even offering him a bribe but he REFUSED to take my car off the hooks.
I felt this guy was VERY rude to me and I'm thinking of pressing charges against the tow truck company...I was in that parking spot for less than 2 minutes and he had my car...it was almost like he was waiting for me...

do I have a case against him and my 100.00 impound fee?

Uh, in a word, No.

Hospital ER parking lots are private property and reserved for whomever the hospital deems they are reserved for. If there is a spot marked for "Dunkin Donuts Customers Only" then you'd be fine. I am betting there isn't. Then getting upset because he didn't accept your bribe? Now that is funny. The cost of the tow and storage plus whatever contract they have with the hospital is worth way more than a donut bribe I bet.

I know its tough, but swallow it and pay the fee. You are wrong and I really think you know it. No one is that oblivious to the world.

In los angeles you can't park on a lot of streets after 4:00. I've seen the ticket police and tow trucks come a few minutes past 4 and take cars away ($140 fine). If you car is already hitched up it's gone in 60 seconds, that's the way it is.

Some of these ticket guys are real jerks. One day they yelled at one of my customers and so I told the guy in a polite way that my costumer didn't see the signs. This guy ans. me in a very rude way and said "sir I'm not speaking to you", and continued yelling at my customer. Then I read in the newspaper how a lot of parking officers are complaining about how bad the public treats them and they are threated and sometimes beat up. Well gee I wonder why?

At the risk of playing devils advocate, I think there is more to this story than you're telling us. I imagine you were gone longer than 2 minuets.

I deal with towing vehicles all the time, and even under ideal circumstances it takes more than two minuets to get a vehicle hooke up, let alone on the truck.

As for him being rude, unless you have witnesses you won't be able to prove it. Based on my own experiences, I imagine you got irate with him first. They get a lot **** from people all the time, the guy is just doing his job, pay the impound fee.

Forget it. It will cost you 100.00 to pay and a learned a good lesson to park in non emergency areas next time. Probably someone has seen you do this before, and decided to call the tow truck on you.

A hospital's emergency areas are not a convenient parking area to get donuts, there are real emergencies happening all the time.

WOW! You have a great deal of self importance! You were parking in an emergency area of a HOSPITAL. What if, someone in your family needed that space for an emergency situation, but someone with an over inflated ego was parking there so he could get his coffee!??? They should charge you double to retrieve your car...better yet, they should keep it indefinitely, some one as inconsiderate as you, doesn't deserve the right to drive.

Heck no you don't have a case!! The emergency parking spaces are there for a reason. You deserve everything you get, give me a thumbs down or whatever, you were in the wrong!!

Funny. I answered this same question a couple of months ago. Got best answer too. I'm reminded of the adages that say "Only a fool makes the same mistake twice.", and "Insanity is when you do the same thing over and over and expect a different result".

Take a real good look in the mirror. How would you feel if you were taken to the hospital & could not find a place to park in the emergency zone. STUPID!!!!

I hope this is a joke, but if not, you surely do not have a case - doesn't even sound like you've learned your lesson! Shame on you, emergency parking is for emergencies, not coffee!

No, you don't have a case. In the first place, you are not supposed to park there. That's the purpose of the "Emergency" sign, duuh.
