lets say you are driving in the left lane, someone comes up to your right and moves over into your lane just barely missiing hitting the right side of your car and did not signal or warn you (they didnt hit you but could have if you hadnt braked) lets say you were driving at normal speed and his actions caused you to hit him. who would be at fault here?

i was driving the other morning on my way to work and a guy dipped right infront of me with no warning. i quickly hit my horn and slowed down but he was so close we could have collided. i was pissed the whole way to work. how dare he do that to me. i guess me going the speed limit ticked him off.

oh no he saw me, i was on the side of him. i know he saw me.

Based upon what you described....you are negligent free. You were attentive, took evasive action to avoid a collision....the other person is a moron.

Depends ... on your state's laws!

You don't give many facts ... but on the whole, taking NY State laws into consideration ... it might be YOU!

Were you driving in the left lane anticipating a left turn? Were you passing slower traffic? or ... were you just being a butthead, traveling in the left lane at the speed limit just to keep others from speeding?

If your answer is "just keeping others from speeding" were you in a Crown Victoria? Did your vehicle have the decals of ANY local Law Enforcement agency?

If the answers to all of these questions is "no" [save for the "just being a butthead" question] ... what the heck were you doing in the left lane?

You hit your HORN before slowing down? Just a guess ... but are you from NY State? How dare he do that to you? How dare you drive at the limit, without reasonable cause ... in the "suicide lane" [the left lane]!

You may have been in his blind spot, causing him to not see you. A collision did not occur, to drive the rest of the way all pissed off was a waste of your time and energy, people make errors, I don't think he meant to cut you off, next time keep in mind the blind spots, every make/model/yr of vehicle has blind spots, including yours.
