My wife was on maternity leave last year when he got hit in the rear end (she was driving her mothers car). Since that time, she saw a chiropractor for about 3 months and is now fine. My 3 week old son saw the doctor and was fine. My five year old was fine but does panic everytime he sees an auto accident. The total medical bills are $1,500 and the adjuster is offering $2,200. Is this fair? I understand that it was not a major auto accident, but she did have to get help taking care of our son while she was recovering on maturnity leave. We asked for $3000 which we felt was fair and reasonable but he did not flitch and told her to give him a call to discuss this? What's fair? Should I tell him I'm thinking about getting an attorney?
Were not seeking a windfall, we just want a fair amount? Any help would be appreciated.

$2200 is fair. without medical documentation of your sons panic attacks....it's not something that can be compensated.
Your wife would have needed help on maternity leave regardless.

Your settlement is not very bad because it was not a severe accident.

Plus, the insurance company worked with you. Your settlement is right between what they had to pay you and what you wanted.

The extra $700 for personal expenses helps cover your wife's loss income. And if she was on maternity leave, she probably recieved money for that also.

You did fine.

That is perfectly fair. People always think they are owed for things they are not in accidents. TO make a long story short.. you are owed NOTHING over medical bills unless you are deemed permenantly injured. Now, most companies will throw in a few hundred bucks extra because they want to settle you.. thats where that 700 came in.

But.. people always say that kinda stuff to me "i couldnt pick up my child for awhile" "now im scared in cars" etc... car accidents are a fact of life... sometimes.. crappy stuff happens.. thats just life. MOney isnt going to fix it and it makes me mad when people feel they are "owed" money for their accident over medical bills.

What will america eventually come to? Will i tell the cashier that i am owed money if i wait to long in the grocery store line?

I understand it was dramatic but your wife is lucky to get that... take the money.. dont drag this out any longer with a lawyer who wont get you any more.. and move on with life

So... your actual damages were $1,500 ... but you want $3,000 damages for this loss!

By all means do get a lawyer! PLEASE!!!!! After your lawyer takes 30% or more for their fee, (now you are down to $2100.00) minus "reasonable and customary expenses" [minimum of $600.00, maximum of $2,100) you will have somewhere between ... $0 and $1,500 for a "Final" settlement! Where you are vs contributing to the month payment on a "Galaxy 5" jet ... silly you!

Sue of course! Several million lawyers depend in people like you to pay for their jets!
