I think you should, its nearly as bad as all those dodgy phone in charges

Sure, sue away! Something tells me though that you don't have enough money to fight a losing battle. There's a reason it's called gambling, there are no sure things. You make your bet and take your chances. But sue anyway, the lawyers need the money.
