The whole idea of a judicial system is to have an INDEPENDANT and IMPARTIAL tribunal. This cannot be achieved by appointing judges on a whim (whoever is in the governemnts good favour and will do as they say) as opposed to based on merit and accredidation. This means that any fool can be appointed, as opposed to the current system where it is based on good decisions, sound reasoning and being impartial. Not having police officers and government officials appoint because the person is more prone to leaning the way they want. Yes police are the most qualified when it comes to crime, but they are also the most biased. Ergo in an impartial system you can not have biased people appointing members of what is to be an impartial tribunal. You might as well merge law enforcement and the judicial system with this move. It defeats the purpose of this system, yet the genius of the conservatives aka Progressive conservative and Alliance party decided that they know better then the rest of Canada

I'm not Canadian friend, but I couldn't agree more. The concept of appointing the judiciary on the basis of wealth, or fame, or popularity, is utterly horrifying. Also the idea of having the police appoint judges etc. The words Hitler and Nazism spring to mind.

I am more concerned about the nilly willy way Senators are appointed, and they have more rights then SCC Judges. Senators are appointed with little or no political experience. The SCC is designed to uphold or strike down laws. The law is meant to be narrowly construed and that's what Judges do, very rarely do they create new laws...as it is a political process not a legal one IE Senators. I am quite sure one does not become a Judge by being a fool as you put it. Perhaps you do not know the way you become a SCC Judge.
