Their biological father pays CSA but he's not wanted to know kids until he did start paying. He saw them for 2 hrs last week. Before that was months ago. My American husband is in the US and we're desperate to be with him. I'm at the lawyers on Monday but wondered if anyone here could help too. My kids are 15 and 12. And we're British.

you will definately win this... you need to either get ex's permission, or if he refuses you go to court for an order to remove them from juristiction. you have a very very strong case...you need to demonstrate what schools, healthcare , living arrangements, family support etc you have arranged, you need to make provision for contact with their father, which can be visits, email, letters , webcam, phone contact.
your case will be looked at favourably because you have american husband, father has had limited contact and your kids are old enough to decide where they want to live. the very best of luck to you

Kids' legal rights are when they turned 18. At ages 15 & 12, as parent, you will have the rights besides of course their biological dad. Not even their step-father has any rights. Paying CSA or not is a different issue thus shouldn't be lump together with the rights.

If your 15 year old and 12 year old want to move to the USA to be with you and your American husband, then they would likely have that right to do so. Yes, it would be good to see lawyers, but I think you have nothing to worry about if your children want to go with you. If they don't want to go, well then that is another story. There is this British law term called "Gillick competency" which looks at a children's age and maturity and allows children to make up their own minds about decisions that effect their lives. Basically the closer to age 16, the more the child will be deemed Gillick competent and have the ability to make decisions for themselves.

Were you married to their biological father?
If not you have a stronger case, however a court may ask the kids to decide. It doesnt sound like they have much to stay here for anyway.

American Law.
US Citizens have the right to have their mother and father with them in the US. They need only to apply through the US State department.
Write to the US State department and ask for their documentation concerning your situation.
The issue in your case, may be about the natural father! GET YOUR INFO FROM THE US STATE DEPARTMENT Not from me or any one else in this forum! We cannot give you passports, or permission! We are all just mouths clapping in the wind!

Hats off to you for divorcing the X, for anyone to use their children as weapons is despicable seems that as he is having to pay for their up keep that he feels is due a part of them. Fight him all the way untill he becomes worthy of them, Good Luck.

My freind had a similar problem, his wifes new partner lived in spain and it was her desire to be with him,the kids had no choice so she went ,he let it go.Now both kids live with him and rescent their mother for keeping them apart so she could be with the man that split them up.This is only what happend to my friend your circumstances will be diferent but you must put your kids first befor you self or it might come round to bite you in the tail. tuogh decission hope every think works out ok.

i'd have thought you should have some rights, all of you, not just the kids.
