Its the right first name but my last name is mispelled on it. I ahve had some people tell me that I should just ignore it.

Ignore it at your own risk. But remember,if you don't show up, some big ugly guys in uniforms could come by looking for you and drag you to jail till the judge can get your name spelled right.

If they have gotten the address and all the other information correct, don't ignore it or you could be held in contempt of a court order. If you have any questions, call whoever issued the subpeona and ask the same question. If the mispelling is only a letter off or can still be pronounced properly, you'd better appear in court.

First, what the heck is the subpoena for? I hear people talking about getting a lawyer and if this southing small and what you're being charged with faces no possibility of jail time you really don't need one.

Second, if you don't show they'll issue a warrant for your arrest.

Have your lawyer appear in your place. In many jurisdictions, that is an incomplete or incorrect subpoena and can be thrown out....

If you simply don't show up, you risk just annoying the judge, and depending on what the subpoena is for, a possible bench warrant.

Most definitely need to appear. I'm a court reporter and if the judge is in a bad mood... most likely he/she would issue a capias for your arrest. I'm sure you don't want that. However, if something were to come up... like an emergency that could be proven if called to question, then you could call the clerk's office and notify them of the emergency and request a continuance. Appear and make the court correct it! More than likely, your honesty will weigh heavily on the judges decision - whatever the subpoena is for! Don't make a bad situation worse! Honest is the best policy!

You must appear.If you won't, you might get in trouble with some legal matters in the future.It happened to me when I applied for passport with the mispelled name on my birth certificate.It took me 3 months to get a passport because of some questionings.

go ahead and when they type up the warrant they can't really arrest you, so when you get a lawyer that could be your defense. The lawyer could battle it out while you sit in jail. Are you serious? I mean really a cop came to my house and took my husband to the court house because he supposedly had a summons to appear and we never got it. He had to call in to work while sitting in a courthouse. They don't care. They had him sit there till he testified then he was free to go.

You've had some people give you bad advice --- you should appear or you may end up seeing your name misspelled in a variety of other places, like the kitchen duty roster in the prison.

You have to appear in court otherwise you will go to jail for failing to show up.
