so i didn't go to the first hearing. The judgment went to the plantiff. Now i was served again. To show up in court for showing assets, and bank accounts and the last two years of tax papers. titles, and any property owned. Yellow page ad my daughter placed for me 4 or 5 years ago. i never make a dime off of the ad. i became very ill. last year i was granted ssi. Disabeled. Like I said the name on the court paper is not my name, or my daughters name it's no name i've ever used in my life. I guess they made a mistake. I know i owe the money. I have no assets, i live in an apt. i get $670.00 a month. If I still don't go can they take my ssi? And if i do go will they not say, Oh well we had the wrong name. So lets just put your name on the papers? Please don't say get a lawyer. I can't afford a lawyer. If you have a better then thou attitude please don't answer. I need good advice please. If I don't go can they find out i get ssi or will they just find out my bank and seize

my money without knowing i only get ssi? I just don't know what to do. my rent is 516 a month I am so worried. If it's not in my name can they even get in my bank account? The paper server saw my name on the mailbox and said oh maybe your name is not this name on the papers. How can they change a name on court papers after they have made a judgement?

The ad was place long before i had ssi!
The ad was placed 4 to 5 years ago. I got ssi last year in september. So the ad only lasts one year in the phone book. The ssi is not got anything to do with the suit. the suit is for not paying the bill 4years ago.

i'm wondering if they the lawyers for sbc yellow pages can seize my bank account. I get ssi. The ad was long before i was granted ssi.

SSi is not in question. The Ad was placed long before i had ssi. I'm just worried if they can sieze my money for the payment?

there is no social security number on the papers. I asked my daughter not to place an ad because i knew i was too sick to work. I just didn't know it would come to this.

SSI can not be garnished, but if the money goes into the bank, the bank account could be frozen untill you went back to court and proved the money in it came from SSI.
( which you can't afford to do without the money in the bank)

If they are serving under a wrong name, is the social secuity number correct, if so and you were served ( how are they seving you, if there is another name, they can't serve that person if he is not there)

Why haven't you contacted the court, and said that the name on the papers is not you? Your case could be mixed with someone else's. If you have a bank account or any assets, they can be seized. If you don't want that to occur, you will need to close any kind of money accounts you may have. It sounds like someone is suing you, or challenging your disability, is that correct, because you said you got sick and then your letter gets a bit confusing. If your Social Security is being challenged, it would be because of the ad, you spoke of. It wouldn't matter if you made a dime or not, SS would want to know why you could work for the ad, but not work for anyone else, do you see what I mean? I wouldn't sign any court document that I was being served, without my name being on it, if it showed someone else's name, I would say go find them, it's not me.

The answer is simple. If YOU didn't place the ad, then you are not responsible for it. However, it sounds like when you were served papers there was a typo and you chose to ignore it for that reason.

In order for you to be served a supeona, the serving party has to serve you personally, not by mail. If that were the case and you acknowledged being the person whom the server was looking for, you screwed up by not appearing.

No, they cannot touch your SSI.

First of all, it was rather silly of you not to respond to this complaint. By talking to a legal representative and giving evidence of your illness by medical records and a statement from your primary care physician, you could have declared hardship via illness. If you still have evidence of this illness and your primary care physician is willing to give a sworn statement, you can have attorney or a legal representative presented to the presiding judge and go from there.

if it is not your name why do you keep accepting the papers. Return them. They cannnot touch your SSI

From my understanding - they cannot take disability. BUT I would check with a lawyer.
