I am deliquent on my credit cards. I have paid on time for all the years that I have had them. I can no longer pay them but don't have the money to file chapter 7. Have no assets either. All but one of my cards have just added last months bill to this month and put a little note at the bottom about not receiving last months payment. However one card (target visa) started calling me 5 days after my bill was late. I know it is them because I gave them my home phone number when I wrote them and the other cards I gave my cell phone number but none have called as of yet. They start calling me about 8 45 am and call about every hour until about 9 at night monday thru sunday. It is apparently an automatic dialing system because I have an answering machine and it cuts off on it without leaving a message. I don't answer the phone till a person begins to talk. Yesterday I got one message from them and today someone has hung up several times.

I can't afford to file bankruptcy yet as I have no money and no way to save any since I have exhausted my savings to pay my bills all this time and am facing not being able to pay rent in a couple months. They are becoming a nuisance calliing all the time and the idea that they started 5 days after my payment was late really bugs me. I didn't even want this card but when I worked at this store, they pushed it on me to meet their quota. Not a good idea to have a card at a store that you work at. Anyway they fired me last year for a dumb reason ( you know the new manager comes in and starts cutting hours to give to new employees) and after my being one of their best employees so I don't exactly like anything about them.

I am currently sending all my creditors 5 dollars each month (only missed 2 months payments as of now) including the one who is calling me.

Hmm...that sucks. I know how stressed you feel since I'm just like you. I'm behind as well and I get many phone calls. But I'll try to be honest and tell them why I can't pay, they'd usually stop calling me for a while. At least you can be out of stress for a while...

We really need to get out of debt like that. I wish both of us luck. Take care.

If the person calling you is from a credit collection agency, then YES. Under the Fair Debt Collection Practices Act, you can tell a debt collector not to contact you and that you will deal only with the creditor directly. If the person calling you is from the creditor itself, then the FDCPA does not apply; but you can tell them that you don't want to be called any more, that calling is harassment, and that you only want them to contact you in writing by US Mail. Keep written records of everything you do.

I believe you can mail a letter to each of your credit card companies request for them to cease telephone communication all together and request mail only correspondence. Most card companies will honor this request. The other option which may be easier is to call you phone company and tell them you are getting harrasing phone calls and they likely to change your phone number 1 time free as a courtesy. You may want to request this new number be unlisted or place the listing under the name of another family member in the household as to make it more difficult for them to track you down again.

Only by paying your bills will they stop calling.........or you can change your phone number. But, as of this year the Bankruptcy laws changed...........you can still be held liable for all credit card balances. But I think you must earn a certain dollar amount for that to happen. Talk to an attorney.......the first visit is free. And cut up some of your cards.

Hi.

As annoying as they are, you need to answer the phone. In the very least, that will prevent them from calling all the time. Also, offer to pay them a minimum...even if its only $5. Believe it or not, it works. It shows that you are at least making an effort to pay.

If you write the collection agencies telling them to stop calling you they have to. However, you are still technically stealing. Pay them what you can, but they still cant call and say "oh we cant accept such small payments" Yes, they can, they just dont want to. They can sue you for the debt, but any amount you send, they have to take and apply to your balance

I'm really having a hard time feeling sympathetic. They extended credit to you in good faith, and now you're annoyed that they expect you to pay them back?

Being in debt stinks. I know. I've been there. But, what have you done to show that you intend to make good on your debts? You know you're late. Have you tried to initiate any communication with your credit card company to make arrangements on paying off your debt?

If you keep ducking them, what message are you sending them? Take me to court, please.

I know you don't want to hear this, but you need to take responsibility for your actions.

Answer the telephone and tell them to stop harassing you, it is against the law you know. I had the same situation a couple of years back and I just picked the telephone after their continuous harrassment and told them to stop harassing me. I told them the situation, duuuuuuuuh, I had no money at the time and they stopped harrassing me. But, you do need to get some legal help or counseling to straighten out your problem.

look on line to find info on the federal fair dept collection act and send them a cease and desist order with a return receipt request proving they received the letter. upon receipt of the letter, they cannot legally contact you except to notify you of any legal action they may pursue! in the mean time, check out dave ramsey . com. a legit get out of dept teacher who does this as a ministry and WILL NOT try to rip you off with some sceem. i got completely out of dept by following his instructions. be patient, it wont happen overnight, BUT IT WORKS!!!!!!!!! good luck and GOD bless!!

You can file a cease calls order through the credit bureaus and the creditors. This can be found online with those "credit repair packets."
