I entirely agree. The stupid courts Marshall has cost the British Taxpayer some £20million and for what? To prove the men charged were not guilty. If British soldiers are accused of war crimes, they should be tried at the Haig and not here in UK. A British Military Court Marshall has nothing what-so-ever to do with war crimes. Such courts are designed to deal with military matters only - wrong-doings etc by soldiers not war-crimes.

If a soldier goes absent without leave, that is a matter which may be dealt with by a Court Marshall - most especially if this happens while on active service and in the front line.

Not please if a soldier is accused of a war crime.

A Court Martial is the best and fairest trial a soldier can have. The Military officers have served on active service during their carrers and can understand much better how mistakes can be made in a Theatre of War. The Prosecuter and the defence are very experienced lawyers. The difference between civil law and Army law is that if guilty under Army law, the punishment is more severe than a civil court.

International court is no place for a soldier. In a professional army laws of war already exist. Having a International court create their own rules is dangerous for all parties involved.

By definition, yes.

If a soldier commits a crime while in the miltiary, the military has primary jurisdiction to hold a court martial.

The International Criminal Court was primarily set up to try those individuals who could not be brought before any other court.

A court martial is by definition a court for trying military personnel. Martial = military. Soldiers and other service people should not be tried in a civilian court. Things are done in battle that those who have had no experience of service life just cannot comprehend.
