My friends employer told her that she could either quit and have 3 weeks, or be fired. I think it would be better to be fired, because that way she can at least collect unemployment until she finds a new job. Is that the case?

No, she is not pregnant. I just asked in this section because a lot of people seem to hang out here :)
i dont know WHY the boss wants to get rid of her, all I know is that she has been treated like crap there ever since she started. Not sure what they have against her. Maybe they want to get rid of her so they dont have to work around her college schedule? I dont know

Let her get fired, so that she can collect; however it also sounds to me that if her boss is giving her the choice, she should ask if she can be "laid off". That way she can still collect; leave the company immediately and not have the stigma of having "fired" on her record. I would surmise that if her boss is giving her the choice, your friend did something that put her in that position. If she didn't, she has a labor dispute that could cost the company much more than some unemployment. If Boss won't allow lay off, then tell your friend to wait until she's fired, and not report that position on her resume. (She'll have to come up with a reasonable reason for the interruption, but usually staying home with children works real well and it's not something that can be verified.)

I just went though this! Tell her to get a letter of recommendation from him as soon as possible. Have her ask WHY she is being asked to quit...(in my case i discovered the boss and a c-worker were having a fling!--both married) Going for the unemployment is good, but her that is probably why her boss wants her to quit. If she goes for unemployment, he will give her a bad reference.
If she can just drop the job from her resume and forget it happened (and not use any of those co-workers as references) Then maybe she could be fired and get unemployment. BUT if she needs the job on her resume, then she might be better off quitting and going the good reference. I told my jerk of a boss I would quit, but I DID NOT sign anything and went for unemployment anyway. I tell potential bosses I quit because business was very bad...which it was.
Get that letter right away and then she can decided what she wants to do. Also, getting fired does not always mean one can get um employment. They can fight it and it it a huge pain in the neck. If it is a large company they have lawyers on retainer just for these events and the boss will lie to the judge.Tell her good luck for me, it's rough out there!

Well it really depends on why they want to fire her! If she has done nothing against company policy, then she can claim unemployment, but if she has, then she can't claim unemployment and needs to take the 3 weeks and look for another job. She needs to be sure she has the labor board on her side when she decides.

But, if she gets fired thats always on her job history. She'll have to explain to all her future prospective employers what happened. She should quit, In Australia at least you can still get unemployment benefits.

Is it because it she is pregant??? Tell her to call a lawyer!! That isn't allowed it is illegel. I can't remember which Civil rights act that backs this up but you can't discriminate againest a women for being pregant and that guy can lose his job for that.
Thay still need a reason. If they don't have one other then her going to school, then she needs to go higher up (abover her boss) I did that to mine once when she gave me a hard time about me wanting to go to school. You know what that was 2 years ago and they have neer said a word since lol :) I don't think they can say things like that to you period. I know that ca't it is a form of HARASSMENT!!! It is called hostile work enviroment!!

Check with the boss. Some places will let you resign, to avoid being fired, and not interfere with Unemployment.
Quit or be fined?? makes no difference, you're gone. Of course, resigning doesn't leave a firing on your record.

I agree with you even though her boss has given her a HUGE ultimatum. Why did her boss say this? Is it because her boss hates her or is it because she did something bad at work? If it wasn't your friends fault (ex. her boss is doing it for no reason) I think her boss is probably psycho and I wouldn't care if I had to leave if was her!
