wow how could so many be wrong when you change lanes you need to make sure the lane is clear wich you did in passing he didnt when he hit you and to make matters worse the law states when you make a left turn you must yeld to all traffic you were traffic wernt you
i had a friend do the same thing but he just pulled into the left turn lane and som guy who had been drinking was passing acrost the doubble yellow lines it didnt matter my friend got the ticket for making an unsafe lane chainge

Yes you're at fault. Don't tailgate! If someone slows down and isn't using a signal you shouldn't pass them at all! Sorry but you asked for it. You cannot assume you know what someone else is doing in a car. Assume they're drunk & retarded and drive defensively.

I'm going to say he was mostly at fault, though as you said he was slowing down so that should have been a clue that he was up to something. he definately should have done a shoulder check before he lunged into you, but then you should have given him a blast on the horn to make sure he knew you were there. I could see it going 50/50 though.

well uh i think it's kinda both of ur faults.. maybe if u didn't stay that close behind the car u would realize he was turning the other way and it's the other guy's fault for not using his turn signal..

1. You have followed too closely. Safety distance is important.
2. Your assumption doesn't indicate his intentions.
Him
1. He did not use his signal.
2. Hit you in the back.
If he really did hit you in the back, usually you have a greater chance of winning the case.
Your question lack many crucial details.
Is the lane only left turning , right turning or combination of straight and right turn etc.

In NJ, it would be both your fault and his fault.
His fault because he didn't signal and he hit the back of your car.
Your fault because you were following too close and trying to go around him. You didn't have a clear line of sight.
So, here, you would both get tickets, and you would both get points.

You are at fault. In virtually every jurisdiction, you will be held at fault if you hit someone from behind in your auto. In essence, you were not maintaining the proper distance from the car in front of you. Sorry, but that they way traffic laws are written.
Also, if you passed him on the left, you made an illegal pass if there was only one lane.

Yes you are at fault for making an illegal pass. As for the blinker, prove it wasn't on at the time.

Sorry but this one sounds like your fault. Firstly you should never tailgate but secondly even if you assum that he is turning right, you should wait for him to make his turn before you try and pass him.

If you thought he was going to turn right, and he turned left, this was hapenning on an intersection, correct?
If so, this was entirely your fault because you are not allowed to pass on intersections.
