My fiances mom sent him one to sign but it has her name and info, why does she need his signature. We can't ask her because she's a little shady. Also 2005 & 2006 someone else claimed him on their taxes and he had trouble getting his return. Could this be related?

It's not that he's afraid to ask her. He can't stand her and hates to talk to her. She lies alot.

An I-9 form is verification of citizenship or legal work status if not a citizen. It's required by the federal govt. All employers are supposed to get these signed and get copies of the documents specified on this form, as proof of legal authorization to work in the US. They are kept on file in the event the employer has to prove that he/she is not hiring illegal aliens. The employee fills out the top part and then the employer or the employer's representative gets copies of the documents (usually a driver's license and social security card) and then they sign the form.

This form has nothing to do with taxes, But its given to a new employee along with the W-4 form, which does have to do with taxes.

An I-9 is the form the government uses for an employer to prove an employee has a legal right to work in the U.S. There is absolutely no reason why your fiance should be signing a form with his mom's info on it in any case, not just the I-9.

As far as the refund issue, that's unrelated to the I-9. Only one person can claim a dependent, but that's strictly a 1040 issue, not immigration.

An I-9 is a form that is filled out when you are hired with a company. If it has his mom's info on it she should be signing it. The form is not related to taxes.

A W9 Form is a Request for a Taxpayer Identification Number.

Why would she need his Identification number anyway----Is she claiming that she paid him income? That does not make sense to me. You are right to be concerned until you know the reason why she wants his signature on that form. I agree with Bostonian that your fiance should get a backbone and actually confront his mom to ask her what is going on. Don't be afraid to ask her anything!

Here's something I found in regards to the W9 form that may help you:

Purpose of Form — A person who is required to file an information return with the IRS must get your correct taxpayer identification number (TIN) to report, for example, income paid to you, real estate transactions, mortgage interest you paid, acquisition or abandonment of secured property, cancellation of debt, or contributions you made to an IRA.

Use Form W-9 to give your correct TIN to the person requesting it (the requester) and, when applicable, to:

Certify the TIN you are giving is correct (or you are waiting for a number to be issued),
Certify you are not subject to backup withholding, or
Claim exemption from backup withholding if you are an exempt payee.

She doesnt need his signature unless he is her employer--It is a verification form to say she is a legal immigrant and able to work in the US.

The taxes and the I-9 are not related.

It's used to document your right to work in the USA. Unless he works for his mother, there is no need for him to give her one -- just trash it.

If your fiancee doesn't have the backbone to ask her what's going on, your future together doesn't look very good at all. Tell him to get a backbone, or hit the street yourself.
