my husband caught a case in new york and already had an outstanding warrant in arizona. he was sentenced to 6 months in new york and the extradition case to arizona was dismissed. they were both felony charges. since the extradition to arizona was dismissed are they going to release him when his sentence expires in new york? or are they still going to extradite him to arizona to face charges? im confused i called lawyers i both states and they told me to csll each other so i dont know what else to do cux i live in neither states

You need to call the agency in Arizona that originally wanted your husband and ask what the current extradition or geo limits are. They may have changed them if they dismissed the charges, but that is odd. When an agency puts a extraditable warrant in the system they usually do not change the geo limits after the fact. Just call the agency in Arizona and see what they say.

If the case in Arizona was dismissed, then I don't think they are going to extradite him to Arizona. Now when his sentence is served in NY, they will check to see if he has any outstanding warrants before they release him, if any new warrants get issued before he is released, then he will have to take care of those before they will let him go.

It is a maybe,

1. if Arizonia will not pay for the extridition, the warrant will remain active but he will not be held for the warrant.

2. If NY makes a mistake and misplaces the warrant or does not get the hold paperwork on time, they have to let him go.

3. If the warrant is active, and arizonia is willing to pay for the extridiction, he will be held for a hearing.

I hate to tell you,but when he is released from New york,he will be extradited to Arizona to serve his term there,how ever long it will be.Sorry about the bad news.When my ex daughter -in law got out she was extradited to the other state was she had more warrants.

If the case was drop they should release him the day he is schedule to come out but if they did not he will get transfer to do his time if I were you I would just leave it alone because if keep on trying to investigate it you might just get their attention and they will pick up the case again so if you or your husband were told it is drop leave it at that

You said in your post that the Arizona extradition was dismissed, so he is done with that problem, from what I can see.

If Az says they are going to come get him when his sentence is done, NY will hold him up to 72 hrs to be pick up

PERHAPS THE CHARGE IS NOT WORTH THE COST OF EXTRADITION THERE FORE HE WILL BE RELEASED IF THEY REFUSE TO PICK HIM UP FOR THE SECOND CHARGE AFTER THE SERVES THE CURRENT ONE
