It has been almost a year since my friend allegedly bumped into the car in front of him. No police were called, but information was exchanged. Now, their insurance company is saying they will take his license away if he doesn't pay $4000 damages!? What can they do to him legally?

Most insurance companies will require a police report for any damage done over $500. They should have filed a police report after the accident.

Since he didn't, he has to come up with the money for the damages. A lesson learned for your friend.

If the accident occured on private property, like a parking lot, no police report would be filed, it would be a civil matter. It would not be leaving the scene of an accident even if it were on a public road as information was exchanged, but in that case also, it would be a civil matter...neither party would be required to file a police report (but it would have been a good idea).

It sounds like he did not have insurance, otherwise all he has to do is turn the matter in to his insurance company and they will battle it out with the other insurance company.

If he did not have insurance when the accident occurred, he will need to pay the damages or he may get his license suspended for driving without insurance, which is a crime. Criminal charges could be pursued.

Legally they can have his liscence taken away for leaving the scene of an accident without reporting it to the police. Most states allow you to exchange information for minor accidents provided a police report is filed later, but a report must be filed or the insurance company can say you owe more than you probably do. The police report is done to insure the honesty of both parties once the insurance company gets involved, without it you are at the whim of the insurance company.

I'm sorry but this is your fault whenever there is any sort of accident the police should be notified, Tell your friend to pay up.

They can sue him for $4000 and ensure he doesn't get insurance again, which in some states equals no license.
