There's this person I know who's Dog was hit by a car and survived. She had just gotten it from a dog rescue 2wks prior. Her boyfriend was out with the dog and her friends dog and the boyfriend saw the car and yelled for the dog to "come" he didn't listen but the other dog did and then their dog was hit.The owner of this dog told me that the cops were called and there was some damage done to the person who hit the dog's car and she also said that the cops had called her and said there won't be any charges laid, but did ask her if there were any witnesses. The reason for me seeking advice about this is because this girl is a Bull$hitter and I don't believe her when she say's that this is all over with. Now...this is my question, 'Who is responsible for this and what is going to happen?'

Hi, thanx so much for all your replies. The dog resue has no idea of the incident and she said she doesn't want to tell her. Also these dogs were in the owners front yard playing fetch, but the yard is situated by a main highway. I just wonder if they will be charged for the damage done to the person who hit the dog's car? I also agree that they should not have a dog seeing as this is the second dog that they have gotten that was hit by a car but this one survived.

The boyfriend is totally responsible. It is just proof as to why dogs should be kept on a leash. The person in the car could make the owner of the dog pay for the damages to both the person and the vehicle, and they do not have to pay anything for the dog. The boyfriend may get a ticket for failure to have the dogs leashed if they were in an area with a leash law.

The person responsible is the *handler* of the dog that was hit..No liability anywhere else..

for instance, as a walker in dog day care..if a dog gets away from me, and gets hit by a car, causing damage ..I, as the dog walker would be responsible, not the owner of the dog...

the only way the owner would be responsible, is if she KNEW the bf was drunk or drugged at the time, and would be negligent.

In my opinion, the owner is always responsible for his own dog. The owner allowed someone else to take charge of the dog. The boyfriend should accept responsibilty too as he is the one who did not have the situation under control(allowing the dogs to run off leash)

The person who had control of the dog was responsible for it. Expecting a newly adopted dog to come immediately when called is just dumb. Guess the rescue picked the wrong people to adopt to. I'm wondering if the dog is still alive, did the rescue take it back or give it to the idiots who put it in danger in the first place?

The person who had the dog without the leash is responsible. It is likely because the police aren't going to charge anyone.. that they have told the woman if she wants the repairs done to her car, that she should sue the owner of the unleashed dog in small claims court.

Well based on the information that you gave me here I would have to say that the dog walker is at fault for the dog getting hit. When ever you're out walking a pet you should always keep them on a leash. That was very irresponsible in their part to keep their pets unprotected like that.

If there's a leash law in this town, and the dog wasn't on a leash, then I would have to believe that the owners of the dog(s) are responsible.

If you mean legally for the damage to the car-it's the owner of the dog-you are responsible for any damage caused by your animal.

The boyfriend is responsible for everything, since he was stupid enough to be walking a dog by a road without a leash.

i would have to say the boyfriend who wasn't using leashes on either of the dogs. he should pay vet bills and for the damage caused to the vehicle
