I fatherd a child was told it was not mine. 8years later accussed of not paying support. Daughters last name was changed to mothers Ex husbands last name without my knowledge. Is this legal or would permission be neede by her Ex husband to do this and if so is this considered an Adoption on his part.

If the child is over 16 he or she does not need permission they can change their name.If the child is under 16 the mother would need to contact you to release you of your parental rights.If she did not know where you lived she would place an ad in the local paper( for 30 days) of your last know address.It would state that you would be losing your parental rights.Then she is free to change the child's name and the child will be issued a new birth certificate.If she has full custody she doesn't need permission.If you had DNA testing done and it proved you were the father she would need your permission.It is a adoption the ex will assume all parental responsibilities and financial support.You will stop paying child support but if you are delinquent you still have to pay what you owe.

We did this with my daughter. Her father has barely been a part of her life and has not paid child support since she was 2. When we filed we had to put a notice in the paper, that was his notice, if no one showed up at the court date to argue it then it was granted. She wanted her name changed though and she now calls her step-dad daddy. You have to give some sort of notice, it's not an adoption, it's just a legal name change. The notice usually only requires putting it in the paper though.

I know not in NY or NC. I think states vary on this. Also, I know after a certain age you also can't change it without the child's permission...this I believe also varies in states. I also think that in your case, if a paternity test was done and the real father declared, then it could be changed without anyone's knowledge but the father's & mother's.

IF there is paternity established, both parents must legally sign for a child under the age of 18 to change his/her last name. When a baby is born, you can give it whatever last name you want...even if you just want to make one up.

Yes but not legally. We have a child at school who uses his stepfathers name. But on all legal documents he still uses is birth name.

I think you might need the permission of the real father. Hopefully you aren't still with that woman.
