You won't need a paternity test in most states, but you will need to file a petition for adoption with the court. Don't try just having him added to her birth certificate as her dad because that's fraud and can really come back to bite you. You need to hire an attorney and go through an adoption proceding to have it done right in order to protect everyone's rights...especially hers.

Generally formal name changes require a Court Order. The specific mechanics of doing so vary from state to state and from county to county.

If you can afford it, check with a local attorney.

If you can't, check your local court website - they may have information on doing it pro se (without an attorney). It's a fairly straight-forward and simple task.

Your question seems to indicate however that you're not really seeking to change your daughter's name but have your new husband adopt her - this is a much more complicated procedure. You will have to talk to a local family law attorney to do this.

Your husband would need to adopt your daughter in order for her to have his last name. You need to contact a family lawyer to see the steps you will need to take to change your daughters last name.

This may involve paternity testing and petitioning the court to make a name change. Hopefully you can get her natural father to agree. I assume you are going after child support.
