My brother had gotten a dui and we want to get his mugshot for him to remember that day so it won't happen again.

Our police service will not hand out mugshots just because people ask for them. They will however use a mugshot in a media release (for wanted parties for example). Every department probably has their own policy on this. You may be able to get a copy of your own mugshot through a freedom of information request.

As seen in the tabloids, booking photos are given to the press when requested. Information that is releasable under Freedom of Information after an initial arrest are the booking photograph, name, address, date of birth, charges, bond and the location where the incident/arrest occurred.
Booking phootgraphs can be obtained under FOI afterwards only if the person was convicted of a crime. It doesn't necessarily have to be for that one arrest in particular. If you have a conviction under any crime than the picture of you can be released. If however you were say arrested one and one time only and the case was dismissed or nolled (tossed out after 13 months) then the booking photo is unreleasable and is purged and the police report sealed.

Go down to your local police department and ask, that is the only way to really know because it differs between departments
