I told a friend this would not be acceptable, but he claims it would be fine, althought the payment won't make it there until five days later. Also, he gave the officer a bond card when he was stopped for the ticket. Will they return that to me or my insurance company? I don't remember getting it back in court.

Kc I've mentioned that I've already been to court. That's why I'm liable for payment of the ticket.

The bond card belong to my friend. He receives one each time he renews his insurance policy.

If it says that it needs to be paid by the 16th, then they need to have received it by the 16th. Anytime after that and it's late, plain and simple.

When a traffic summons (citation) is issued there is a date and time on the ticket which is the court date.

One or two options is available....either pay the fine through the mail or appear before the court on the time/date indicated.

A failure to pay the fine and appear in court is referred to as a "Failure to Appear."

Some states work differently, however, my own state will consider one of a couple of options:

1) a warrant for failure to appear or;
2) suspension action against the license and driver until the offense is paid.

If the offense is not paid the suspension can be moved to that of a "revoked" status.

In your case, you should telephone the court clerks office in the jurisdiction where the ticket was issued. Explain to them that you have mailed the payment, however, there was a slight delay. Let them know it will be about five days at which time if a warrant or suspension action has been taken...they could possibly hold that action pending the "grace period" afforded you.

That is called playing the not so brite game. The courts can and often do immediately issue bench warrants for the persons arrest immediately.

Better hope the judge is in a good mood when he finally goes before him on the warrant.

Some people may think it is okay, but, this is not a credit card bill, phone bill to where there is a grace period.

Your friend is in violation of the law. Sorry.

On you bond card, call your insurance company or who ever issued your card to get a more legitimate response on that one. They may not be to happy about your card being used by anyone other than yourself.

As long as the court gets their money in a reasonable amount of time, all should be fine. I don't believe a moving violation ticket goes to warrant but, I do know that it will come up when you try to renew your driver license. As for your bond card, you'll have to go down to the police station and retrieve it from property.

no it is not ok, although they may well accept it when it comes in, but by the time it gets there, it could well be shown as not paid ( and if the option of this was to pay or appear) if they were to pay or appear, then by not paying or appearing on that date, normally a warrant will be issued.

Sometimes you will have to get a new bond card issued form the company that issues the card.

First, kick this friend to the curb, you are liable. Second the payment must be made on the 16th....not mailed. What do you think?

I'm not familiar withthe bond card as we don't have those in NC. However, the fines must be received by the date listed or it will be late. Post-mark dates don't count.

Under Federal Law Once you place the envelope in the mail mans hands, it is deemed filed or in this case paid. as long as it is "Post Marked" with the due date it is considered Payed.

As long as they get their money and it is within a few days, they aren't going to do anything. It will take them 2 months to find the ticket!
