I live in a peaceful small town but recently there has been a lot of chaos. One of our most respectable town members, we call him Boss Man, was a former prison guard.

About a month ago, an ex-con who calls himself Nailz, took out ads in the local paper that alleged he was abused by former prison guard (Boss Man) while in prison and also claimed to be innocent of his crimes.

Last weekend at the town carnival, after the arm wrestling competition, Nailz – dressed in orange prison garb (I'm sure bought outside prison) and hell-bent on revenge – charged and brutally attacked Boss Man, eventually using a nightstick to injure his one-time tormentor.

My question - shouldn't the police have done something when Nailz was putting these ads in the paper? If they were proactive Boss Man would not have endured this beating.

Nailz should be charged with assault and probably sent back to prison. The allegations of him being mistreated while in prison should stilll be investigated.

Because I Have personally seen and been a "Victim" of the Brotherhood of Correctional Officers, It seems to me that the former Inmate just leveled the odds that were stacked against Him when He was incarcerated. Some things you "Let Go" of and Some "You Don't"!. Prison Guards under the guise of "Respectable Citizens" inflict some of the worst "Torture", physically and mentally upon inmates while they are employed as a Guard. What alot of them fail to realize is that there are some that don't forget, and WILL exact revenge. If "Nailz" Nailed the "Boss Man" and took the chance of going back, then it must have been something serious enough to warrant the attack. I'm not saying that I would condone Nailzes actions, but I myself when it happened to me "Thought" about breaking this guys legs with a baseball bat just to let him know one on one, He's not so tough. Prison Guards are notorious for grabbing an Inmate that files a Complaint against one of them and 4-5 Guards kick and/or beat the Inmate to near Death and then band together and claim the Inmate was jumped by other Inmates. So, Maybe Boss Man got His "Just Reward"!

The ads may have been Libel which is a civil offence. Boss Man could have taken action in civil court.

Boss man could have applied for a restraining order using the ads as prrof of imminent danger.

If Nailz was really innocent of the crimes, it wasn't Boss Mans fault he was behind bars. Nailz should have appealed. That part of the argument falls.

If Nailz was abused in prison, Nailz should have reported that at the time to the appropriate authorities. The argument is specious.

What should have the police done about the ads?
Arrest the guy because he might assault someone in the future?
We arrest people who have committed offences or sometimes who are planning to (conspiracy to commit murder etc.). You need some kind of evidence to lay charges.
If the guy had stalked or threatened the guard and the police had done nothing there would be something there, but ads in a newspaper don't cut it. The guy could have been sued civilly for slander if the information in the ads was not true. The police will be able to use the ads as part of the evidence during this person's trial for the assault.

Nailz is obviously guilty of assult if there are witnesses to the brutal attack, so he isn't innocent this time.
As for Bossman he also may well have been guilty of some pretty bad stuff too, and karmatically was re-paid let's say.
The police might have been more quick to react but they can not break the law themselves to prevent a crime that has not yet taken place. However, they should have been near by to prevent innocent people from being hurt in the melee.

I'm curious, what's the status of Nailz? Was he arrested for the alleged assault? In custody? Did Boss Man have to go to the hospital? Is any news of this available online?

Vigilante Justice, you can be sure will break out more and more if people start feeling they can extract no Just Court. No fair conviction, nor defense , nor sentence. Then to be abused and threatened while "In the Custody" of societies "Justice System", anger and paranoia will build as real,and imagined injustice are angrily glaring in the face of people. At the very least this man's claims needed to be addressed. We are all aware their are abuses Abu Gray means none can say I could never have imagined. CIA has honed their craft to a fine art. Who have they tested craft on,in controlled well funded programs as opposed to real world terror suspects (ya). Abusing the prisoners allows lots of study and funding....Mary

I personally would think there is an investigation going on with this matter because it is a very unusual thing for a formal inmate to go after his guard after he has served his time and would risk going back into Prison. There is no law against free speech. if it is untrue thet's another thing but, it needs be proved.

Something should have been done beforehand. It's a shame it had to happen. The only bright side is they can lock him back in prison where he belongs.

I am sure the convict will be going back to the pen real soon. As far as doing something before he did, we can't arrest for what someone is thinking of doing.
