Hi, my bike was stolen recently and I'm in the process of submitting an insurance claim however on my policy it clearly states "kept in locked building." My bike was taken from my driveway during the night, it was locked and had a cover on it, it's not a small bike and would have taken at least 2 to 3 strong guys to lift into a van etc, I'm quite sure it was taken with the lock still in place as there wasn't any evidence of bits of lock, brake disc etc on the driveway in the morning, all these details are on the police report, which the insurance company will obviously have access to. Does anybody know where I stand with regards to my claim? or has anybody been in a similar situation?
If I'm not going to be paid out A) I've lost the value of my bike and B) My car insurance will also go up at renewal even if I don't get paid !! I'm livid !! Please Help!!

OK so strictly you did not comply with the terms of your insurance that is "in a locked garage"

Now you may well have just got home and briefly went inside the house with the view of putting the bike away before retiring to bed and simply forgot but who is to say at what time you get home. Could have been 12 hours before the theft or maybe 12 minutes if you get my drift. You might have just finished your "late shift" and got home at say 2am

Under this circumstance you would be responsibe to have secured your bike in the locked garage before finally going to bed. However if you were to have been going out a while later maybe after a shower then you might have left the bike out to re-use

It's all in the wording

Well if you try to claim it the way you wrote it, it's concidered fraud. The only way you can possably get away with it without being charged for fraud is to say there was another trade+Cash, or servises offered. like tell them the bike was worth 5000$ but you paid 1000$ because he owed you $$ or something(But be sure to tell the guy what is happening so if anyone contact's him he is ready for Questions). incurance companys will do whatever they can to not pay you!! that's there job and how they stay in business. they will not hesatate to get record from Ministry of Transpertation or send claim info to them. just something to think about. and good luck with that.

U may be able to pmt for the bike being stolen, but not for 30 days. That is generally the amt of time that insurance companies require a stolen veh to be missing before pmt is issued. Secondly they will most likely make you sign the title of the bike over to them, because then if it is ever found ,they will get there pmt back.. As long as you had comp on the policy you should be good to go..

If your policy states that the bike will normally be kept in a locked building, there is usually a note stating that if it is stolen within 500m of your property and it's NOT in a locked building, you are not covered for theft.

If you can't prove it was in a locked building, you will not be able to claim.

Are you worried about it being on the drive instead of inside? Not really a problem, after all it could have been stolen from a car park while you were out. You're not obliged to keep in permanently inside, it's just that they want to know where you NORMALLY keep it.

If your insurance coverage is there for total loss, you will have be paid by Insurance company. There will a delay in getting it because you have to produce a certificate from Police that your bike is not traceable, which they issue only after full investigation after 3 months.
