All you have to do is contact YOUR insurance company. Their job is to "go after" the insurance company of the person who hit you. You will not have to file suit against them personally except in special and uncommon circumstances. Fortunately the person that hit you had insurance..... unlike the knucklehead that hit me a few years ago. Regardless, you insurance company should be the one to handle all of these details.
You also have the right to choose a repair shop of your choice and get your own estimate, and ignore the repair shop's demands for the insurance co's estimate.. Oftentimes the costs of repair vary GREATLY from one shop to another. In your case, it sounds like the lower the repair estimate the better off you'll be since you prefer to keep the car.
But, definately, contact your insurance co even if you only have liability because they WILL have the legal representation to make things happen.

If they are totalling out your car, they should be paying you for your cars value. Now this will probably differ from what you think is it's value. Most go by blue book value www.kbb.com can help you with that or www.nada.com Why would you sue the other person though? If you were to take it to court and you were being offered fair value of your car? I understand the inconvience, but it's called an accident for a reason. But to answer the ? you would sue the OWNER of the car b/c they are responsible for the car. If the driver was someone other than the owner of the car, you can sue that person too, but I don't believe you would get very far with it.

If the amt of damages are more than the value of the car. Then legally they only have to pay you fair market value to replace the car.. If the fair market value for your car is enough to purchase another car, they most likely could give a ****.. They is why its always better to use your own insurance(as long as there collision on your policy). I would recommend filing with ur insurance, and having the adj come out to see if he think's its totaled, or not.. U have to remeber that these claims adj's are not always right, they were trained out of a book, and make mistakes just like the rest of us... LOL>.. Good Luck

The most any company, either theirs or yours, will pay is the actual cash value of the vehicle at the time of the loss. You can't get paid any more than that. You can't sue for the loss of your vehicle, actually, you can, but you are suing for the same amount that they would have paid you if you wouldn't have sued. If you have full coverage you can claim thru your own company, pay the deductible and then your company can go after the other company for the damages including your deductible. If you have liability only, your ONLY choice is to go thru the other company. Your company can't handle the claim for you if you have liability only on your vehicle.

you definitely have to consult your insurance company and ask their advice. I'm sure they encounter that problem all the time. As far as suing people, you'd have to sue the person responsible and sue them for damages, and loss of wages if you needed your car for work. And possibly pain and suffering.

I would contact their insurance company. That is the first step. If you don't succeed, sue the driver/owner.

What are you suing for? The cost of repairs exceeds your cars worth...they owe you the value of the car. If you were paying it out of your pocket...which would you pay? They've done nothing illegal.
