I am currently on probation for a first DWI. I am off in August, but I have been extended due to a minor previous violation, failure to contact after I moved. So a 2 year prob. has turned into three. Today I failed a UA, so I am gonna have to go before the judge. Realistically, what is likely going to happen to me? If I take it upon myself to check into a rehab before I go before the judge, is that going to improve my situation any? What is likely to happen then?

You may be discharged from probation with unsatisfactory rather than having your probation extended or going to jail.

You could also be sentenced to drug court where they will do a better job of motivating you to attend/remain in rehab.

I was arrested twice for DUI or DWI, the second arrest violated my probation for the first. I served 48 hours. However, if you are, and have been steadily employed, they are less likely to send you to county. Checking into rehab is not going to keep you from going to jail. Speak with your PO let them know what your situation is, more than likely they wont ask the judge to sentence you, rather may ask for additional urines. They have many programs at their discretion, offer to work with the PO to find a program that works. Or just hire a lawyer and fight it.
