You're basically renting the car. If she stops using the car and returns it, then there's nothing to sue for. If she continues to use the car, then you can sue her for the time she uses the car and didn't pay the monthly payments. But that is all after the fact. You can't sue her for future use, and you can't get a court order for specific performance.
Regardless of your agreement, you owe the bank the money and you're required to make the payments. If you can prove that she used the car for a period of time and she didn't make the payments during that time, then you can sue her for the amount of the payments. But without a written agreement, you may have a hard time proving the existence of the agreement.

Have a witness or pay to go to small claims, u may have to pay for subpoena. Appeal to friends around this person to do the right thing, go to that person's family. Sheesh, what a pickle. When I was in Okinawa during the Vietnam thing I signed pwr of atty. Of course, no money ever came my way after I go medivac'd stateside.
Usually, if it's not in ur pocket...it'll wear out, devalue, get stolen, or used. The Utility may have been worn also.

As they say, a verbal agreement is worth the paper it's written on.
However, since she had been making payments for so long, this could be evidence of the agreement.
Go to small claims court. (Unless you're still in Iraq.)

YES!!!! And also repo it and sue him for the balance. A verbal agreement (handshake) in all the states I know is as good as a written agreement. This is what a bank can do and so can you

you can sue them over this and probably win,but any good lawyer is going to ask you why you didn't get a written agreement drawn up on this ,but yes you can sue them over it,and if it came to it i guess i would ,anything to keep your credit strait would help,good luck with it ,i hope it works out.
