It is a fruit because it contains seeds. Vegetables are the leaves, roots, tubers, and stems of plants. Fruit is a plant's way of reproducing. So many people think that sweetness has to do with whether a food is a fruit or not, but that is not actually the case. Tomatoes are acidic with little to no distinguisable sweetness, but they contain seeds.

When the flower on the tomato plant / vine is fertilised it develops into the tomato fruit ,so it is the fruit of that plant, however it is used as a vegetable in the preparation of so many food items, world wide, when it comes to you in the market or store you will find it along with all the other vegetables in this section of goods. The same would apply to many other vegetables like eggplant, okra, all pumpkins & gourds, all grown as the fruit of the given plant.

Botanically speaking, a tomato is the ovary, together with its seeds, of a flowering plant: a fruit or, more precisely, a berry.
the term "vegetable" has no botanical meaning and is purely a culinary term.
The U.S. Supreme Court settled this controversy in 1893, declaring that the tomato is a vegetable
