My pickup truck was totaled today by an 18-wheeler that ran a stop sign. I am in Arkansas, My insurance was expired I was on way to renew it.

You can try, but you were driving illegally. We have people phone our office, give us the credit card, and we renew for them, so they are covered when they come in to pick up the paperwork. With phone, fax, and e-mail available, you will have a hard time convincing anybody that the only accident you had just happened to be the day you decided to drive in to renew your insurance.

Unfortunately, you are in the wrong. I know this really sucks, but you shouldn't have been on the road without insurance. If you hadn't been on the road in the first place, the truck couldn't have hit you. Probably the best you can hope for is for the truck driver to take partial blame, since he ran the stop sign - but this is only an option if your insurance agent will verify that he was expecting you at that time. Even then, you still have a rocky road ahead of you.

Tell me, how long ago did the insurance expire? And why did you have to go anywhere to renew it? You have to admit, it'll look a little suspicious to the cops.

If your insurance was expired some states would make you at fault no matter who caused the accident. If that is not the case in your state and if the 18-wheeler was at fault which it sounds like it was then the 18-wheeler driver's insurance should pay for the damages to your vehicle. Talk to your insurance agent and they should be able to give you the answers you are seeking even though your insurance was not in effect at the time of the accident. Good luck to you.

Why do you need a damn lawyer? I'm sure the 18 wheeler had insurance and if it was indeed his fault then his insurance should pay for your vehicle (unless, of course you live in a 'no pay-no play' state).

Why asking all the wannabe lawyers on here for advice. Go talk to an accident lawyer. If there is money to be made they do your case for free.

Oh, the sob story that you were going to renew it. Well, I really don't believe that one. When people have accidents they "forget" to renew or they were going to get it next week. Yea.

If the truck that hit you was at fault then you may get a ticket for no insurance but he is still at fault and yes you can sue. However, if it is in question as to who was at fault then you my dear have a huge problem. Either way you should probably consult an attorney as I don't know what your state statues are. Go talk to a personal injury attorney. They generally work on a contingency basis meaning they dont get paid unless you do. Basically, what you do, you'll go talk to the attorney, tell them about the accident, what your injuries are, etc. I'm really surprised that no one from the other guy's insurance company hasnt called you yet. I'm sure that he told his insurance company about it. Did you get any of his insurance information? also, make sure that there was a police report made.

it depends on if you can prove he ran the sign and if so it can be difficult to get a judge to give you a dime. he'll probably just say too bad, so sad and just fine the truck driver.

Anybody can sue for anything, it seems. So contact a lawyer and see what they say. The first meeting is usually free. I hope no one was injured in the wreck.
