Or what can we do so he doesn't have to leave in 5 months? We are filing the I-130 form now, but I don't want him to have to leave! Any suggestions will be helpful! He is an Italian citizen.

Your husband can only extend his J-1 visa if the program is continuing and he is still involved full time. If not, he can request a change of status from J-1 to B-2 via form I-539; these aren't always granted, but it might be worth trying:

The extension depends on a few things. Is he subject to the 2 Year Home Residency Requirement (not likely in Italians). If so, has he applied for a waiver? If he's applied for a waiver, and had it approved, he CANNOT extend or transfer J programs. How long has he been here? Js have a 5 year maximum (recently changed), so make sure to add it up correctly. If he's been in the US before on a J category, that time may be added to that 5 year, so double check.
If his current place won't extend him, he can try to transfer to another institute as long as he hasn't applied for and received his waiver.

Just curious why dont you both live in Italy? We have alot of immigrants in the USA and I dont think we can handle more as it is a burden on our economy.
How would your husband feel if thousands of Americans went to Italy everyday to take money from italys economy?
I just wish people would leave the United States Alone
