Dear Susie,
First of all they shouldn't deport your Dad because it is Against the Law to deport a caretaker for a
juvenile in the United States..if he is your only legal Guardian
then that can be claimed in court as a hardship and he will be
urged to complete or fulfill his Citizenship..in which I hope he
will readily agree to and Fulfill.
Next is the matter of the ticket...If he doesn't have a valid
driver's license issued in the state of his residence ..well..
he can expect not to be driving for too long if he is caught...
he needs to get his residency established in the State and
then go for his Driver's License so this won't happen again

If your dad does not have a valid license to drive (a license from mexico is not sufficient in most states) and the police officer knew this and saw your dad driving then he could stop your dad for that offense alone. Your dad will still have the ability to fight the speeding ticket, if he was charged with speeding. People don't often get deported for traffic offenses, however, if your dad is not in the country legally then he may indeed face deportation, as he is not supposed to be here.

No--the police conduct in this case was not legal. Unfortunately--there's little liklihood anything can be done except pay the traffic ticket--and watch out for similar traps in the future.
And yes--there is clearly racism at work here. That's wrong. And believe me--most Americans do not share that attitude. Here's a tip: the best way to defend yourselves is to look for--and get to know and be riends with--those Americans who are not racist--and that applies to both you and your father. Then if these scum try something, you will have allies they can't threaten.
I wish I could say this kind of thing will just go away--and eventually it will. But its going to be years. Its a historical pattern you see in many countries--not just the United States. Each new group of immigrants is subjected to deragatory tretment by the most ignorant and narrow-minded people. After a generation or so, as the new immigrant group integrates into the society, such abuse fades away. But it will take time. Good luck to you--vaya con Dios! :)

I was a cop in Arizona and we didn't deport anyone unless it was at least a felony. It is possible that someone put a friend up to it but I can't help with that. File a complaint with the officers department. At the very least it starts the document trail. If it happens again after that then you start to show a pattern. I hope it was a one time thing. He will not be getting deported for not having a U.S. License, unless he commits a felony, which he did not. He needs to pay the ticket (thank his lucky stars his car did not get impouded if not insurance) and move on with traffic school.

It sounds like your dad was arrested for no operator's license. Mexican Driver's Licenses aren't any good here.

My advice is contact a lawyer as soon as possible. When it comes to immigration law advice just doesnt even scratch the surface. Sorry i couldnt be of more help.

Your dad needs a real good lawyer. It sounds like it was racialy motivated but again, your dad will need a good lawyer to help him. Other than that, I dont know what to tell you.

if you are scared of getting deported get a green card or American citizenship. if you dont then you will get deported. if you dont like the rules here about that well you wont like the rules in the other countrys because most dont even tolerate it
