My husband was placed on probation in Novemeber 2004. He is scheduled to be done with probation in November 2007. However, the probation office has changed the amount he was supposed to pay 3 times. He has never had a restitution hearing. There is no way that we can pay the remaining balance on his probation in 8 months. What will happen?

The balance will be forwarded to your state's central collection office; However, the probation will end on 11/07.

The judge had to order restitution when he sentenced your husband to probation. There is a record of restitution somewhere in the legal documents.

I don't believe that probation can be extended if the restitution remains unpaid but I don't know what state I'm dealing with here.

The probation officer will take your case in front of a judge and say your husband has failed to pay which will then issue a warrant for his arrest. He then will get to tell the judge why
he hasn't paid. I would suggest taking it to the judge yourself
and explain the circumstances then work out a payment plan
on what is actually owed. Get everything on paper with signatures! Sounds like someone has been filling their pockets.

They will hold him on probation until he pays off what he owes, but if you think that you have payed what is owed you should bring this up to the friend of the court and make sure you can show proof that you made the payments with receipt

he probally wont be able to get off probation until he pays it off.
