Hey Rob,

I guess I can't reply. Questions and answers only here.

So my question is about your statement;

If you defaulted on your Student Loan your refund WILL be offset to pay towards the debt that you owe

I have a student loan that is defaulted, 18 years ago btw.

In the past 10 years it has NOT been offset/garnished.

What makes you say it will be?

Furthermore my original question was regarding the statement in the 'Where's my refund' section, not your opinion on if I will be or not, garnished. Also my wife has defaulted student loans and she gets her refund every year just like me. Hers is 6 years old, the defaulted loan.

Anyway, if you have any information about the question I asked, not your opinion, please assist me.

Thanks

** We filed jointly fyi.

Yes the refund will be offset, the spouse who is not responsible for the debt can submit an Injured Spouse claim to the IRS to receive the portion of the refund that is attributed to her income

If both you and you spouse are current on paying the Student Loans, they are not considered to be defaulted, there by the refunds would not be offset

It doesn't make sense that it hasn't been offset at this point, I would advise that you call the IRS to see if an offset indicator is showing on either of your social security numbers with the IRS

I only have been given hosed via FMS. To the final of my expertise I owe no longer something to any Fed company, and my childrens are grown and long gone. And my student loans are in deferment till 06/09/07. yet they only saved $13,000 of my refund.... is there besides i will discover out in the event that they are only discovering if I owe something, or is this a diverse that somebody is claiming $13k of my money?? in case you examine IRS subject remember 203...its exceedingly obscure. It just about reads like the FMS can carry a factor or all your refund till the IRS "certifies" your refund. i think of its exceedingly incorrect that the IRS and/or FMS can carry your money hostage if all they are doing is "looking into in case you owe money". thank you on your help.

Are you aware you can return to your question and add 'Additional Information'? That way you don't waste points on a new question that may not make much sense without the original question.
