Upgrading Vista from XP isn't recommended and yes you need a valid license for XP to upgrade to Vista. The safest way is to do a clean install of Vista, if you really want it that is.

Don't do it! In practice it will be possible though. Why not use the Vista upgrade trick instead? It is widely publicised - try http://www.winsupersite.com/ as a source. The document you are looking for can be found under the "Windows Vista" section - titled: How to Clean Install Windows Vista with Upgrade Media.
I am not sure how legal this is but given that you claim to run a pirated version of XP - you are probably not bothered.

I can't see any reason at this point to upgrade to Vista actually. I've read loads and loads of reviews and every single one says it's more trouble than it's worth. I like XP and will not change willingly.

Vista... Hmmm.. I prefer XP, but since I had to opt for a replacement PC after a serious fault, the new one has Vista.. So still trying to get my head round it.
I suppose it can only get better!

No need to use illegal software.
Get UBUNTU (or XUBUNTU if your computer has less than 256MB of RAM).
It's a free, reliable and up to date operating system.
You can explore it from the "LIVE CD".
It's easy to install and use. You can dual boot it with other operating systems.
Once you have it installed, you gain access to thousands of free programs created by the open source community. There is excellent support - see the WIKI starter guide, and the Linux forums.
Always back up your data before making changes to your computer.

No, you can't and also, your pirated copy is putting your computer at risk!! MS can now detect pirated copies and will eventually warn you that it is, and then shut your OS down. You also cannot get important Security Updates.
