The contraband doesn't have to be in your physical possession to be charged. There is "constructive possession". This means that the contraband was in a place that you could readily access and there were other extenuating circumstances. You don't have to use the drugs to be charged. You're being charged with possession not consumption.

If they can prove that you knew it was in the car, then yes, you can get in trouble as well. Really depends on how your state treats certain activities.

Laws are different from state to state, In GA. laws if no admits to it being theirs then yes useally all parties are charged.Call a local attn. in your area for a free consultation (in the yellowpages) it will say if that one does free const.

Yep, most people clean out their cars. If they were found in the car you were driving then you are considered responsible for what's in your car.
