My friend has taken her children away from her father. She says he is doing drugs but has no actual proof of this. Is it legal for her to do this and if not how can it be fixed??

She needs to go to her local child welfare office and let them know what she believes is going on. She needs to tell them that she feels her children's safety is in jeopardy and that someone needs to investigate the matter. She needs to demand that a drug test be given to her father. Also,to rule herself out as a drug addict, and for more grounds for her to stand on (if she is trying to regain custody), she needs to submit to a drug test as well; that will be to her benefit in the long run.

Who has legal custody of the children? If they both have then it more than likely legal - depends on the state and she can go to court to petition for sole physical and legal custody. If it's not legal she needs to call Child Welfare Services in the county she is in and make a report on the father.

she needs to file a compaint with the court stating that she beleives he is unfit for parenting. Then explain her course of action, if not she could face kidnapping charges. she can not legally keep the children from their father. Every father is entiltled to see his kids during surpervised visitation or unsupervised. that is also determined by the court. even if the father has physically harmed the children he still has the right to see them.

~ Who would know about his drug use more than his bride?

~ It sounds like she's doing the proper thing to protect her children and herself.

~ I would think she would have called the police before doing this... at least to start a file of his activities, allowing her custody of the children in the future...

~ By running away from the spouse, may cause other problems...

~ She needs to talk with her pastor and to pray about her husband's drug problem... they (husband and wife) should seek council from their church pastor... they may have a drug rehab program for him that would strengthen his Christian walk, as well as help him over the influence of drugs.

well depending on what state you live in, its her child and if she beleive its in danger she has the right to take the child away. BUT there are laws and you have to follow them, contact someone that would know about you local laws and procedures like a lawyer. if it goes to court they will test him and if its true the chance of him seeing his baby again will be slim till he can prove that he is clean,. thats the way it works most of the time. contact a professional though babe
