It is required that you file a return every year, that is why there is a Filing Deadline of April 15th every year, (17th for 2006)

Both people are talking about 2 different types of deadlines.

The deadline to file a tax return is April 15th of every year for most tax payers on most years (2006 it is April 17). The penalty for filing a tax return late is 5% of the amount owed per month up to 25% of the amount due with a minimum of $100. This penalty is usually not enforced is you are due a refund.

The deadline to claim a tax refund for most people is the later of 3 years of the due date of the tax return or 2 years after the tax return was filed. For example you can claim a refund for this years tax up until April 15 of 2010. The penalty for not filling for your refund on time is that you have donated the money to the United States government.

As with most things tax related there are some exceptions to the rules.

You must file yearly by 4/15. You can file for an extension but is only for several months not 3 yrs.

Every year, regardless of whether or not you owe the government money. Even if they owe YOU and you don't want the money you're still required to file yearly. If your taxes aren't too incredibly difficult it's worth it to just take it all to H & R Block and let them have the headache of filing. Plus, the money you spend for them to do your taxes is tax-deductible next year! If you're taxes are not complicated it won't cost much at all. It's worth it if you hate filing taxes as much as I do!
