Ok well i got in a small parking lot fender bender back in 2005
and they are just claiming it now
is that legal?
i currently have murcury insurance

Was there a ticket involved? If no, wait for the lawsuit and then negotiate @ make your case. If ticket involved, Yes, two years, also depending in state you reside in. In some states, your license can be suspended for not paying - under failure to provide proof of financial responsability.
Therefore it is much better to go to your insurance agent.

They can make a claim any time they want within the Statute of Limitations for that state. You'd have to see what the Statute of Limitations is in CA. It may be two years.

That depends on your state's statute of limitations. I'm not sure what the average statute of limitations is but some are around 7 years.

Who was your insurance in 2005 when this happened? Contact them, and let them know what is going on.

Then, if you get contacted by their insurance company, refer them to the company that insured you in 05.
