My husband is going through the process of immigration. I am a born U.S. citizen. We have already been working with a lawyer and they have begun the paperwork part of it. Nothing has been sent off yet. Once everything is sent off how long will it take for him to get a work permit/social security number. I've heard about 3 months. Is this true? How about the adjustment of status/green card? When will he be able to travel outside of the U.S. and re-enter legally? We are planning a trip to go to Costa Rica and are just wondering about when we may get to go. Thanks for any input!!

Let me clarify that we are living in the US currently. He came legally. He has stayed here longer than he was supposed to. The lawyer gave us an estimate but I wanted to see what other peoples' experiences were.

Some times they said it will take only 3 months, for that, actually I've known people that got this green card in six to seven months, now depends on the lawyer, and you should know by now, that inmigration issues are always been delayed by anything, if is not this is the other one, but they have to make you wait, regardless, if they are not investigating your case, he should get his permit like an another month or so, but like I said if they think there's something fishy, they will investigate all over the case, I really hope that everything comes in good fortune to you and your husband, this year is when applying for mine, so you know I'm ready.

from the info you provided i would say if your lawyer told you about 6-9 months, then he may want you to feel surprised and impressed when it goes thru faster, in about 3-5 months. But what do you mean begun the paperwork, nothing has been sent off, should not take more than a week to gather all necessary documents, complete the forms and send them out, unless you don't have all the money to pay the fees and your attorney, then money is the hold up, but remember the attorney works for you, remind him there are others you could have hired but you chose him, try to work a payment plan while the application is being processed, if you still have a balance with him when appointment time comes he can always request to re-schedule interview until you pay him off, but he needs to paid, if you have already paid then there should be no reason for delaying the process, unless the alien has some legal issues that are affecting his application process.

If you´re talking about filing the I-130 Petition for Alien Relative it takes 9 months to a year for approval. It won´t take longer than that unless your husband entered the US illegally or overstayed his visa. Upon approval he will be issued a Green Card as a conditional permanent resident which will be good for 2 years.

I´m going through the same process with my husband now but he has never been to the US and I am currently living with him in Mexico.

I am in exactly the same position as your husband, actually about to go and get my required shots! Permission to work and social security is about 3 months, that is correct. After about 7 months (maybe less) he will be able to leave the US as by then he should have his green card. If you want to leave and re-enter before then you can get a form but I think that costs you more money to file. Good luck.

He will get the green card instead of the work permit.and the social security should arrive in 3 weeks after he got approved and yes it is true once he get approved it should take 3-4 months to get the green car.

I am in the same situation. I am a British citizen and my wife is a US citizen. We live in the States and filed for my adjustment of status last November. We were given a Notice Date of 21 Dec 06 and according to my wife's Congress person the process is supposed to take 90 days to complete. Unfortunately, they still haven't reviewed our application so we are still waiting. I don't there is much choice but to sit and be patient. I wouldn't advise filing for the temporary work visa (I-765). It takes 90 days to process and if they approve your adjustment of status application in the meantime you will automatically receive an EAD (Employment Authorisation Document). So essentially it is a waste of money and a bit pointless.

6 weeks to get work permit with that work permit he have to go to SS Office to apply for a SS# I am not sure how long will take for him to get the SS# he can ask to the SS office about the waiting time for the SS# ...6-9 months to get green card until then he can travel out of US...Never before, Is not recommended...Because coming back he need the Green card.

it will take 2 years once you send the paperwork before they give you an appointment at the embassy. Once you go to the embassy, it will be at least 5 mos (maybe 1 year) before the US will make their decision. sorry, Im sure you didnt want to hear that! I have been through it, my husband is from Mexico and I opted to live in Mexico while we waited, I didnt want to be without him for that long.

the only other thing that can get hung up is the FBI name check. they have there own thing they do and if your name is a common name or some one with a name like yours did something bad it could take a while for the FBI to clear you. sometimes years
