I have been victimised by my employer for a number of years but have not taken any action because of the stress it would cause me and I also have a 3 year old child and am a single mum and fear of losing my job. My empoyer is a local authority. I was recently passed over for promotion again due to victimisation due to previous grievances taken out against senior management some of whom were on the interview panel. I was eventually given another lower position. I had my first supervision session yesterday with my Line Manager who is also in on the plot. In the middle of the supervision session I noticed a tape on the table making a sound as if the tape had ran out and i asked her if she had been recording our conversation and she said yes. I asked her if she had asked for my consent and she said she did but I could not recall her asking for my consent.

What action can I take against my employer and what laws has she breached. I am fed up and intend to take the matter further

Keep a diary of everything! go to ciitzen advice who will help you and they will point you in the right direction or telephone ACAS ( in telephone book ) who are a legal body to help you. Why they would tape an interview is beyond me and am pretty sure they have breached some laws..the employer does not always know the laws hence why people get massive compensation. goodluck.

as an employee of the company...you do not have any rights to privacy ...you e-mail, and your desk is not yours ..they are property of the company all contents of that desk whether you or the company purchased it is the companies...all conversations that are made within the context of your workplace are not private and can be subject to scrutiny. the only place you can expect privacy is in the restrooms. you signed a code of conduct? how about an intellectual property agreement?

you want some vengeance...go to your doctor...tell him you are under a great deal of stress and have been feeling depressed...then have him/her recommend a stress leave... now go to your employee and take a stress leave...this is a short term disability..it costs the employee nothing..it is all covered by their insurance...while you are under this short term leave...look for another job...procure that other job and then when you get back quit.. no notice..

You have to be made aware that a recording is being made.

That is why whenever you call a helpdesk or support centre, they always say it is being recorded for training purposes when it is in fact simply there to act as a withness.

Legally, she must ask you for your permission before taping your conversation.
