if possible could you tell me the law or website that it is on...i have talked with several law enforcement officers and gotten mixed results.

KC V is partially right. But it is NOT illegal to carry a firearm openly. It is only illegal to carry a pistol concealed without a license. It is not illegal at all to carry one openly, unless you are a convicted felon or have a domestic violence conviction. There are exceptions to this, such as carrying one on school property, or at a demonstration, but generally you can carry one openly at any time. The criminal code section he quoted is correct, but there are no prohibitions on carrying openly with or without a license. Hate to confuse you even more.

To make sure I was correct on this, I also contacted a local investigator who handles all our gun crimes, he is also deputized through the B.A.T.F.E. so he makes gun charges not only in state Court, but Federally as well. He stated the same thing. You need no license to openly carry a pistol in Alabama.

As a police officer in the State of Alabama, I can refer you to the law below concerning the carrying of firearms in the State of Alabama.

The law is cited under Title 13A of the Code of Alabama.

Section 13A-11-73
License to carry pistol in vehicle or concealed on person - Required.

No person shall carry a pistol in any vehicle or concealed on or about his person, except on his land, in his own abode or fixed place of business, without a license therefor as hereinafter provided.

(Acts 1936, Ex. Sess., No. 82, p. 51; Code 1940, T. 14, §175; Acts 1947, No. 616, p. 463, §3; Acts 1951, No. 784, p. 1378; Acts 1956, 2nd Ex. Sess., No. 43, p. 336; Code 1975, §13-6-153.)

To paraphrase the law it simply says this:

You are "REQUIRED" to carry the pistol concealed when located anywhere other than your own property or in your vehicle or fixed place of business (provided your business authorizes the carrying of a weapon). To carry a weapon unconcealed in any other location is illegal and to carry a weapon without a permit other than listed above makes you subject to arrest!

You may seek further laws concerning the carrying of weapons under Section 13A-11-50 through 13A-11-61.1 on the internet by going to "Code of Alabama 1975."
